Terms of sale<\/strong><\/h3>

The business conditions apply to customers (hereinafter: Customer) who purchase products from MB Studio (hereinafter: MB Studio)<\/p>

\u00a0<\/p>

PAYMENT AND PRODUCT PRODUCTION<\/strong><\/p>

The customer undertakes to pay for the ordered products to MB Studio, using the payment method indicated on the received offer\/proforma invoice. If the customer has decided to pay by advance invoice, an offer with all the product information will be sent to the electronic address of the recipient of the invoice.
Upon receipt of funds to our business account, the product will be adjusted according to the Customer's specification, after which a picture of the final appearance of the product will be sent to the Customer for approval.
By sending the approval, the Buyer confirms that the product is clearly adapted to the wishes and needs of the Buyer, and on this basis, the Buyer loses the right to unilaterally terminate the contract.
<\/strong>From the receipt of manufacturing approval, we need a maximum of 7-10 working days to manufacture the product, unless otherwise indicated on the offer itself.<\/p>

TERMS AND CONDITIONS OF DELIVERY\/EMERGENCY DELIVERY<\/strong>.<\/p>

Delivery terms are set out in the Order Confirmation and are indicative and subject to extension depending on any public holidays, extraordinary or occasional events or production requirements. Urgent delivery of the product and\/or delivery within the mandatory period must be requested from MB Studio at the time of Request for Offer, clearly and in writing, and must be expressly accepted by MB Studio in the order confirmation.<\/p>

RECEIVING THE PRODUCT<\/strong><\/p>

The buyer is obliged to check immediately after the delivery of the package whether the products and quantities are specified in the ORDER CONFIRMATION and the approved graphic simulation. All complaints must be submitted in writing no later than 14 days after delivery. If no report is received, the goods will be considered accepted.<\/p>

PRODUCT CLAIMS<\/strong><\/p>

The customer has the right to complain about the purchased product within 14 calendar days of receiving the product. In case of a product complaint, the customer is obliged to contact MB Studio in writing by mail or email. In the complaint, it is necessary to state the order\/invoice number, the type of problem and attach pictures of the advertised product.
Justified complaints can only be accepted before damaging the product, such as cutting the product or applying glue to the product and\/or placing the product on the wall.
<\/strong>Based on a written complaint for product replacement, MB Studio will return a written response to the customer within 15 days with an explanation for accepting or rejecting the complaint.
In case of a positive response to the complaint, MB Studio will offer the customer the possibility of making a new product in the shortest possible time. In case of a positive response to the complaint, the customer will return the product at his own expense in the condition in which it was delivered and in the original packaging to the address of MB Studio (the address will be indicated in the written response).
After taking over the advertised product, within 14 days, depending on the Customer's wishes, MB Studio will create a new product in the shortest possible time and deliver it to the Customer at no additional cost.<\/p>

COLOR AND TEXTURE TOLERANCES<\/strong><\/p>

Bilo kakve varijacije u boji i teksturi izme\u0111u kona\u010dnog proizvoda i prethodno dostavljenog uzorka i\/ili prototipa ne bi se trebale smatrati proizvodnim gre\u0161kama i, stoga, ne mogu biti predmetom pritu\u017ebe. Ovo se na\u010delo tako\u0111er primjenjuje na razlike prona\u0111ene unutar iste serije narud\u017ebe. Ove se tolerancije trebaju smatrati svojstvenim karakteristikama normalnog sustava digitalnog ispisa, gdje proizvodni proces i specifi\u010dnosti upotrijebljenih materijala mogu rezultirati malim varijacijama u boji i teksturi koje ne ugro\u017eavaju kvalitetu, svojstva i estetski izgled kona\u010dnog proizvoda.<\/p>

MB Studio nagla\u0161ava da nije mogu\u0107e jam\u010diti to\u010dnu uskla\u0111enost boja izme\u0111u dizajna otisnutih na razli\u010ditim materijalima, jer na boju i ishod dizajna utje\u010du specifi\u010dne karakteristike odabranog materijala.<\/p>

MEASUREMENTS<\/strong><\/p>

In order to prepare the design and for the wall wallpaper to be successful, it is first essential to measure the walls on which it will be installed. Taking measures and their correct delivery to MB Studio is the sole and exclusive responsibility of the Customer. In the event that measurements, data and information are incorrect, MB Studio will not be held responsible for defects or deviations in the product or for damages of any kind.<\/p>

WARRANTY <\/strong><\/p>

MB Studio declares that the products are in accordance with the Croatian and EU sector standards that apply to the reference product category. It declares that the products are made to fulfill the function of furnishing accessories and\/or interior decoration. It confirms that the technical characteristics of the product are those contained in the reference technical sheet. Without prejudice to the content of the point entitled \"RECEPTION OF THE PRODUCT\", any claims related to product defects must be sent to the registered office of MB Studio in Zagreb, Vukomera\u010dka 43, Croatia within 14 days of discovery and in any case before the product is used, under penalty of forfeiture. Use of the materials implies an implied disclaimer of any warranty of merchantability. In the event of a discrepancy, the Customer must give MB Studio the opportunity to verify the actual existence of the defect and its extent, also by sending photographic images and\/or samples of the disputed product, if requested by MB Studio. Any defect and\/or deterioration and\/or modification not attributable to MB Studio is excluded from the warranty, including:<\/p>

  • Changes in color or differences in shades that fall within the normal tolerability of the product category.<\/li><\/ul>
    • Errors resulting from use that does not comply with the highest manufacturing standards and\/or deviates from the MB Studio instructions and\/or due to the use of inappropriate or low-quality adhesives.<\/li><\/ul>
      • Changes or deterioration resulting from the use of cleaning products that are non-specific and\/or corrosive and\/or differ in some way from those specified in the instructions provided by MB Studio.<\/li><\/ul>
        • Consequences for the product due to use that is not in accordance with what it was designed for.<\/li><\/ul>
          • Changes or deterioration caused by external factors and events, even if accidental, also due to the wall and\/or the environment on which it is used, such as moisture, mold, scratches, gaps, cuts, burns.<\/li><\/ul>

            Application of MB Studio wallpapers on surfaces not specifically mentioned in the manuals or in the company's official installation videos (for example wood, laminate, metal, resin or similar materials) or for purposes other than those for which the wallpapers are designed (for example installation on the floor, doors, panels, outdoors or in similar environments) does not comply with the manufacturer's instructions. Therefore, in such cases any warranty given to the customer will be null and void and MB Studio will not accept any contractual or non-contractual liability for the same, nor will it be liable for any product defects and\/or performance differences discovered as a result. In such cases, the product shall be deemed to be sold at the buyer's risk and peril, and MB Studio shall have no obligation, nor shall it be responsible for honoring any warranty.<\/p>

            Without prejudice to the above and provided you share the relative technical characteristics, MB Studio may make suggestions regarding the treatment of your installation surfaces, but only as a form of mere courtesy and without accepting any responsibility, upon your request. In the event that you request proposals and\/or subsequently make a purchase order, it will be considered that the parties are aware of the above conditions and that you have expressly confirmed and accepted them.<\/p>

            PROMOTION OF MB STUDIO PRODUCTS<\/strong><\/p>

            Authorization to promote MB Studio products within e-commerce platforms is exclusively reserved for partner sellers who possess a full sample of the company's promotional tools and is subject to specific restrictions and requires prior written approval from MB Studio. The publication of product prices within the e-commerce area is not permitted under any circumstances. This policy aims to ensure the integrity and quality of information disclosed, thus protecting both partners and end consumers.<\/p>

            COPYRIGHT<\/strong><\/p>

            Sve slike podlije\u017eu autorskim pravima i ne smiju se reproducirati bez pismenog pristanka MB Studio.<\/p>

            CONTRACT DURATION<\/strong><\/p>

            The contract that the Buyer concludes with the Seller is a one-time contract for the purchase and sale of products at a distance, which is concluded by the delivery of the goods and the payment made by the buyer, in case it is not terminated.             Op\\u0107i uvjeti poslovanja<\\\/strong><\\\/h3>

            Uvjeti poslovanja odnose se na kupce (u daljnjem tekstu: Kupac) koji kupuju proizvode od MB Studio (u daljnjem tekstu: MB Studio)<\\\/p>

            \\u00a0<\\\/p>

            PLA\\u0106ANJE I IZRADA PROIZVODA<\\\/strong><\\\/p>

            Kupac se obvezuje naru\\u010dene proizvode platiti MB Studio, na\\u010dinom pla\\u0107anja navedenim na zaprimljenoj ponudi\\\/predra\\u010dunu. Ako se kupac odlu\\u010dio za pla\\u0107anje po predra\\u010dunu, na elektronsku adresu primatelja ra\\u010duna bit \\u0107e poslana ponuda sa svim podacima o proizvodu.
            Po primitku sredstava na na\\u0161 poslovni ra\\u010dun, proizvod \\u0107e biti prilago\\u0111en prema specifikaciji Kupca nakon \\u010dega \\u0107e slika finalnog izgleda proizvoda biti poslana Kupcu na odobrenje.
            Slanjem odobrenja, Kupac potvr\\u0111uje da je proizvod jasno prilago\\u0111en \\u017eeljama i potrebama Kupca te se po tom osnovu gubi pravo na jednostrani raskid ugovora od strane Kupca.
            <\\\/strong>Od primljenog odobrenja za izradu, potrebno nam je maksimalno 7-10 radnih dana za izradu proizvoda, osim ako to nije druga\\u010dije nazna\\u010deno na samoj ponudi.<\\\/p>

            UVJETI I ODREDBE ISPORUKE\\\/HITNE ISPORUKE<\\\/strong>.<\\\/p>

            Uvjeti isporuke navedeni su u Potvrdi narud\\u017ebe i okvirni su te podlo\\u017eni produ\\u017eenju ovisno o svim dr\\u017eavnim praznicima, izvanrednim ili povremenim doga\\u0111ajima ili zahtjevima proizvodnje. Hitna isporuka proizvoda i\\\/ili isporuka u obveznom roku mora se zatra\\u017eiti od MB Studio u trenutku Zahtjeva za ponudu, jasno i pismeno, te mora biti izri\\u010dito prihva\\u0107ena od strane MB Studio u potvrdi narud\\u017ebe.<\\\/p>

            PREUZIMANJE PROIZVODA<\\\/strong><\\\/p>

            Kupac je du\\u017ean odmah po isporuci paketa provjeriti jesu li proizvodi i koli\\u010dine navedeni u POTVRDI NARUD\\u017dBE i odobrenoj grafi\\u010dkoj simulaciji. Sve reklamacije moraju se podnijeti u pisanom obliku najkasnije 14 dana nakon dostave. Ako se ne primi nikakvo izvje\\u0161\\u0107e, roba \\u0107e se smatrati prihva\\u0107enom.<\\\/p>

            REKLAMACIJA PROIZVODA<\\\/strong><\\\/p>

            Kupac ima pravo u roku od 14 kalendarskih dana od preuzimanja proizvoda na reklamaciju kupljenog proizvoda. U slu\\u010daju reklamacije proizvoda, kupac je du\\u017ean kontaktirati MB Studio u pisanom obliku putem po\\u0161te ili elektronske po\\u0161te. U reklamaciji je potrebno navesti broj narud\\u017ebe\\\/ra\\u010duna, vrstu problema te prilo\\u017eiti slike reklamiranog proizvoda.
            Opravdane reklamacije mogu\\u0107e je uva\\u017eiti jedino prije o\\u0161te\\u0107enja proizvoda kao \\u0161to su rezanje proizvoda ili nano\\u0161enja ljepila na proizvod i\\\/ili postavljanja proizvoda na zid.
            <\\\/strong>MB Studio \\u0107e, na osnovu pisane reklamacije za zamjenu proizvoda, kupcu vratiti pisani odgovor u roku od 15 dana s\\u00a0 obrazlo\\u017eenjem o prihva\\u0107anju ili odbijanju reklamacije.
            U slu\\u010daju pozitivnog odgovora na reklamaciju, MB Studio \\u0107e kupcu ponuditi mogu\\u0107nost izrade novog proizvoda u najkra\\u0107em mogu\\u0107em roku. U slu\\u010daju pozitivnog odgovora na reklamaciju, kupac \\u0107e o svom tro\\u0161ku proizvod vratiti u stanju u kojem mu je dostavljeni i u originalnom pakiranju na adresu MB Studio (adresa \\u0107e biti nazna\\u010dena u pisanom odgovoru).
            Nakon preuzimanja reklamiranog proizvoda, MB Studio \\u0107e u roku od 14 dana ovisno o \\u017eelji Kupca izraditi novi proizvod u najkra\\u0107em mogu\\u0107em roku i dostaviti ga Kupcu bez dodatnog tro\\u0161ka.<\\\/p>

            TOLERANCIJE BOJE I TEKSTURE<\\\/strong><\\\/p>

            Bilo kakve varijacije u boji i teksturi izme\\u0111u kona\\u010dnog proizvoda i prethodno dostavljenog uzorka i\\\/ili prototipa ne bi se trebale smatrati proizvodnim gre\\u0161kama i, stoga, ne mogu biti predmetom pritu\\u017ebe. Ovo se na\\u010delo tako\\u0111er primjenjuje na razlike prona\\u0111ene unutar iste serije narud\\u017ebe.             MB Studio nagla\\u0161ava da nije mogu\\u0107e jam\\u010diti to\\u010dnu uskla\\u0111enost boja izme\\u0111u dizajna otisnutih na razli\\u010ditim materijalima, jer na boju i ishod dizajna utje\\u010du specifi\\u010dne karakteristike odabranog materijala.<\\\/p>

            IZMJERE<\\\/strong><\\\/p>

            Kako bi se pripremio dizajn i kako bi zidna tapeta bila uspje\\u0161na, prvo je bitno izmjeriti zidove na koje \\u0107e se postaviti. Uzimanje mjera i njihovo ispravno dostavljanje MB Studio isklju\\u010diva je i isklju\\u010diva odgovornost Kupca. U slu\\u010daju da su mjerenja, podaci i informacije neto\\u010dni, MB Studio se ne\\u0107e smatrati odgovornom za nedostatke ili odstupanja u proizvodu ili za \\u0161tete bilo koje vrste.<\\\/p>

            JAMSTVO <\\\/strong><\\\/p>

            MB Studio izjavljuje da su proizvodi u skladu s hrvatskim i EU sektorskim standardima koji se primjenjuju na referentnu kategoriju proizvoda. Izjavljuje da su proizvodi napravljeni da ispune funkciju dodataka za opremanje i\\\/ili unutarnjeg ure\\u0111enja. Potvr\\u0111uje da su tehni\\u010dke karakteristike proizvoda one sadr\\u017eane u referentnom tehni\\u010dkom listu. Ne dovode\\u0107i u pitanje sadr\\u017eaj to\\u010dke pod naslovom \\u201ePRIMANJE PROIZVODA\\u201c, bilo koji zahtjevi koji se odnose na nedostatke proizvoda moraju se poslati registriranom uredu MB Studio u Zagrebu, Vukomera\\u010dka 43, Hrvatska u roku od 14 dana od otkri\\u0107a i u svakom slu\\u010daju prije proizvod koristi, pod kaznenom kaznom oduzimanja. Kori\\u0161tenje materijala podrazumijeva implicitno odricanje od jamstva koje se odnosi na prodaju. U slu\\u010daju nepodudarnosti, Kupac mora dati MB Studio priliku da provjeri stvarno postojanje nedostatka i njegov opseg, tako\\u0111er slanjem fotografskih slika i\\\/ili uzoraka spornog proizvoda, ako MB Studio to zatra\\u017ei. Svaki nedostatak i\\\/ili pogor\\u0161anje i\\\/ili izmjena koja se ne mo\\u017ee pripisati tvrtki MB Studio isklju\\u010dena je iz jamstva, uklju\\u010duju\\u0107i:<\\\/p>

            • Promjene u boji ili razlike u nijansama koje spadaju u normalnu podno\\u0161ljivost kategorije proizvoda.<\\\/li><\\\/ul>
              • Gre\\u0161ke koje proizlaze iz uporabe koja nije u skladu s najvi\\u0161im standardima izrade i\\\/ili odstupa od uputa MB Studio i\\\/ili zbog uporabe neprikladnih ili nekvalitetnih ljepila.<\\\/li><\\\/ul>
                • Promjene ili pogor\\u0161anja koja proizlaze iz uporabe proizvoda za \\u010di\\u0161\\u0107enje koji su nespecifi\\u010dni i\\\/ili korozivni i\\\/ili se na neki na\\u010din razlikuju od onih navedenih u uputama koje daje MB Studio.<\\\/li><\\\/ul>
                  • Posljedice na proizvod zbog uporabe koja nije u skladu s onim za \\u0161to je napravljen.<\\\/li><\\\/ul>
                    • Promjene ili pogor\\u0161anja uzrokovana vanjskim \\u010dimbenicima i doga\\u0111ajima, \\u010dak i ako su slu\\u010dajni, tako\\u0111er zbog zida i\\\/ili okoline na kojoj se koristi, kao \\u0161to su vlaga, plijesan, ogrebotine, zjapi, izrezi, opekotine.<\\\/li><\\\/ul>

                      Primjena MB Studio zidnih tapeta na povr\\u0161ine koje nisu izri\\u010dito navedene u priru\\u010dnicima ili u slu\\u017ebenim videozapisima tvrtke o ugradnji (na primjer drvo, laminat, metal, smola ili sli\\u010dni materijali) ili za druge svrhe od onih za koje su zidne tapete dizajnirane (za primjerice ugradnja na pod, vrata, panele, na otvorenom ili u sli\\u010dnim okru\\u017eenjima) nije u skladu s uputama proizvo\\u0111a\\u010da. Stoga \\u0107e u takvim slu\\u010dajevima svako jamstvo izdano kupcu biti ni\\u0161tavno i neva\\u017ee\\u0107e, a MB Studio ne\\u0107e prihvatiti nikakvu ugovornu ili izvanugovornu odgovornost za isto, niti \\u0107e biti odgovorna za bilo kakve nedostatke proizvoda i\\\/ili razlike u izvedbi otkrivene kao rezultat. U takvim slu\\u010dajevima, smatrat \\u0107e se da je proizvod prodan na rizik i opasnost kupca, a MB Studio ne\\u0107e imati nikakve obveze, niti \\u0107e biti odgovorna za pridr\\u017eavanje bilo kakvog jamstva.<\\\/p>

                      Ne dovode\\u0107i u pitanje gore navedeno i pod uvjetom da dijelite relativne tehni\\u010dke karakteristike, MB Studio mo\\u017ee dati prijedloge u vezi s tretmanom va\\u0161ih instalacijskih povr\\u0161ina, ali samo kao oblik puke ljubaznosti i bez prihva\\u0107anja bilo kakve odgovornosti, na va\\u0161 zahtjev. U slu\\u010daju da zatra\\u017eite prijedloge i\\\/ili naknadno donesete narud\\u017ebenicu, smatrat \\u0107e se da su strane upoznate s gore navedenim uvjetima i da ste ih izri\\u010dito potvrdili i prihvatili.<\\\/p>

                      PROMOCIJA MB STUDIO PROIZVODA<\\\/strong><\\\/p>

                      Ovla\\u0161tenje za promicanje MB Studio proizvoda unutar platformi za e-trgovinu isklju\\u010divo je rezervirano za partnerske prodava\\u010de koji posjeduju potpuni uzorak promotivnih alata tvrtke i podlo\\u017eno je posebnim ograni\\u010denjima i zahtijeva prethodno pismeno odobrenje od MB Studio. Objavljivanje cijena proizvoda unutar podru\\u010dja e-trgovine nije dopu\\u0161teno ni pod kojim okolnostima. Ova politika ima za cilj osigurati cjelovitost i kvalitetu informacija koje se otkrivaju, \\u010dime se \\u0161tite i partneri i krajnji potro\\u0161a\\u010di.<\\\/p>

                      AUTORSKO PRAVO<\\\/strong><\\\/p>

                      Sve slike podlije\\u017eu autorskim pravima i ne smiju se reproducirati bez pismenog pristanka MB Studio.<\\\/p>

                      TRAJANJE UGOVORA<\\\/strong><\\\/p>

                      Ugovor koji Kupac sklapa s Prodavateljem jednokratan je ugovor o kupoprodaji proizvoda na daljinu koji je konzumiran isporukom robe te izvr\\u0161enim pla\\u0107anjem od strane kupca, u slu\\u010daju da ne bude raskinut.
